General Terms and Conditions (GTC)
for the catalog shop of G. Wurm GmbH + Co. KG at katalogkaufen.wurm.com
§ 1 Applicability of the Terms
1.1 These GTC apply exclusively to contracts for the order of the printed catalog of G. Wurm GmbH + Co. KG via the dedicated online shop at katalogkaufen.wurm.com.
1.2 Deviating terms of the buyer shall only apply with the seller's written consent.
1.3 The invalidity of individual clauses does not affect the validity of the remaining provisions.
1.4 German law applies exclusively. The UN Convention on Contracts for the International Sale of Goods (CISG) is not applicable.
§ 2 Conclusion of Contract
2.1 The presentation of the catalog in the shop does not constitute a legally binding offer, but an invitation to order. By submitting the order, the buyer makes a binding offer. The contract is concluded with the order confirmation or the shipment of the goods.
2.2 Field service employees are not authorized to conclude contracts via this shop.
2.3 Deviating agreements require written form.
2.4 Illustrations and information about the catalog are non-binding, unless they are expressly designated as binding.
§ 3 Delivery
3.1 The delivery of the catalog within Germany usually takes place within 5–10 working days after order confirmation.
3.2 There is no minimum order value.
3.3 Delivery is made by postal dispatch at the seller's risk.
3.4 Partial deliveries are excluded.
§ 4 Prices and Payment
4.1 The price for the catalog is stated in the online shop and includes statutory VAT and shipping costs.
4.2 Payment is made in advance using the payment methods offered in the shop.
4.3 Shipping only takes place after receipt of payment.
§ 5 Returns
5.1 A return or return shipment of the ordered catalog is excluded.
5.2 The right of withdrawal is excluded according to § 312g Abs. 2 Nr. 1 BGB, as it concerns a product that is not suitable for return.
5.3 Unpaid or unannounced returns will not be accepted or refunded.
5.4 Should the catalog arrive damaged or in a defective condition, the buyer is obliged to contact the seller immediately by e-mail or via the contact form. In this case, a replacement delivery will be considered.
§ 6 Retention of Title
The delivered goods remain the property of the seller until full payment.
§ 7 Place of Jurisdiction, Final Provisions
7.1 The place of jurisdiction is Cologne, provided the buyer is a merchant, a legal entity under public law, or a special fund under public law, or has no general place of jurisdiction in Germany.
7.2 The contract language is German. In case of deviating language versions, only the German version is valid.
7.3 The law of the Federal Republic of Germany applies.
